Last updated: 29 May 2026

Our Commitment: ClearPath is committed to protecting personal information and handling it in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We are committed to protecting your personal information and handling it in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains what personal information we collect, how we collect it, why we collect it, how we use and disclose it, and what rights you have in relation to your information.

By using our website, submitting a form, registering an account, or purchasing a service, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.

If you have questions about this Privacy Policy or our privacy practices, please contact us at support@clearpathmodificationadvisory.com.au.

We also capture campaign attribution parameters (utm_source, utm_medium, utm_campaign, utm_content, utm_term) from the URL on your first visit to understand which external links brought you here. We do not send names, email addresses, phone numbers, registration numbers, VINs, uploaded documents, or free-text notes to our analytics platform.

Customer Communications

  • Enquiries submitted via contact forms or email
  • Support requests and correspondence
  • Feedback and survey responses

We collect and use personal information for the following purposes:

  • To deliver advisory services and generate reports requested by you
  • To process Risk Scan submissions and produce advisory outputs
  • To respond to your enquiries, support requests, or feedback
  • To process payments for services purchased

  • To meet our legal and regulatory obligations
  • To protect our legal rights and interests

We will not use your personal information for purposes that are unrelated to the above without first informing you and, where required, obtaining your consent.

Certain information submitted through the ClearPath platform — in particular, vehicle details, modification information, and towing configuration data submitted through our Risk Scan and advisory tools — may be processed using automated software systems and assessment frameworks.

These automated systems assist with:

  • Calculations relating to vehicle weight, payload, and towing configuration
  • Risk identification based on submitted information and available reference data
  • Generation of advisory report content and summaries

You have the right to request that a human review any assessment where you believe an automated output may be inaccurate or materially affected by an error. To request a review, contact us at support@clearpathmodificationadvisory.com.au.

We do not sell your personal information to third parties under any circumstances.

We may disclose your personal information to the following categories of third parties where necessary to deliver our services or meet legal obligations:

  • Payment providers — Stripe and associated financial institutions, for the purpose of processing payments
  • Website and application hosting providers — for the purpose of operating and maintaining the platform
  • Cloud storage and software-as-a-service providers — for data storage, processing, and platform functionality
  • Professional advisers — including legal advisers, accountants, or insurers where reasonably required
  • Regulatory authorities — where we are required by law to disclose information to government agencies, law enforcement, or regulatory bodies

Where we disclose information to third-party service providers, we take reasonable steps to ensure those providers handle information in a manner consistent with Australian privacy law. We do not disclose personal information to third parties for their own marketing purposes.

We take reasonable steps to protect personal information we hold from misuse, interference, loss, unauthorised access, modification, and disclosure. Security measures we employ include:

  • Secure hosting infrastructure with reputable cloud service providers
  • Access controls limiting who can access personal information within our systems
  • Encryption of data in transit using HTTPS/TLS protocols
  • Password protection and authentication controls for account access
  • Regular review of security practices and service provider arrangements

No online system or internet transmission is entirely secure. While we take reasonable steps to protect your information, we cannot guarantee the absolute security of data transmitted to or stored on our platform. You use our services at your own risk in this regard.

If you become aware of or suspect any unauthorised access to your account or personal information, please contact us immediately at support@clearpathmodificationadvisory.com.au.

ClearPath uses third-party cloud infrastructure and software-as-a-service providers to operate its website and platform. Some of these providers may store or process data in server infrastructure located outside Australia, including in the United States, European Union, or other jurisdictions depending on service provider infrastructure arrangements.

Where personal information is disclosed to overseas recipients, we take reasonable steps to ensure those recipients handle the information in a manner consistent with the Australian Privacy Principles, including by relying on contractual obligations, certification schemes, or other appropriate safeguards where available.

By using our services, you acknowledge that your information may be transferred to, stored in, or processed in overseas jurisdictions as described above. If you have concerns about overseas disclosure of your information, please contact us before submitting personal information.

Essential local storage

We use essential local storage (browser storage) to remember your privacy preference and to run core site features such as calculators and saved sessions. This storage is necessary for the site to function and is used regardless of your analytics preference.

Optional Google Analytics

With your permission, we use Google Analytics 4 to understand how visitors use our website in aggregate — for example, which pages are visited, which tools are used, and approximate geographic region. Analytics is off by default and only begins after you explicitly accept it via the privacy banner shown on your first visit. We do not use analytics to collect the details you enter in calculators or forms — no names, email addresses, vehicle or caravan details, registration numbers, or free-text inputs are sent to analytics.

What analytics measures

In aggregate, analytics records page views, tool engagement (e.g. calculator started, tow match completed), and conversion events (e.g. checkout started, purchase completed by transaction ID). Campaign attribution parameters (such as utm_source) may be captured from the URL on your first visit to understand which external links brought you here. All event parameters are limited to non-personal, non-identifying values.

Changing or withdrawing your preference

You can change or withdraw your analytics preference at any time using the “Privacy settings” link in the website footer. If you withdraw consent, ClearPath stops sending analytics events immediately and removes any Google Analytics cookies accessible to our site. Withdrawing consent does not erase data that Google may have already collected and stored under its own policies while analytics was enabled.

No advertising or marketing cookies

We do not use advertising cookies, cross-site tracking pixels, or third-party marketing cookies. Google Analytics is configured only for site usage measurement, not for personalised advertising.

Under the Australian Privacy Principles, you have the right to request access to personal information we hold about you, and to request that inaccurate, out-of-date, or incomplete information be corrected.

To make an access or correction request:

  • Contact us in writing at support@clearpathmodificationadvisory.com.au
  • Include your name, email address, and a description of the information you wish to access or correct
  • We will respond to your request within a reasonable time, generally within 30 days

We will provide access to the information we hold about you unless an exception under the Australian Privacy Principles applies. In some circumstances, we may need to verify your identity before providing access.

We do not charge a fee for making an access or correction request. However, if a request requires significant effort to compile, we may notify you of any reasonable administrative cost before proceeding.

We retain personal information for as long as is reasonably necessary to fulfil the purposes for which it was collected, or as required by applicable law.

In practice, this means:

  • Account information is retained while your account remains active and for a reasonable period after account closure
  • Advisory reports and assessment records may be retained for a period to enable us to respond to service queries, complaints, or legal claims arising from those services
  • Financial transaction records may be retained for the period required under Australian tax and financial record-keeping obligations (generally 7 years)
  • Enquiry and support communications are retained for a reasonable period to manage ongoing correspondence and service history

When personal information is no longer required for any lawful purpose, we take reasonable steps to destroy or de-identify it in a secure manner.

You may request deletion of your personal information by contacting us at support@clearpathmodificationadvisory.com.au. We will delete your information where we are not required by law or legitimate business purpose to retain it.

We may send you marketing communications about our services, new features, knowledge base articles, or advisory resources where:

  • You have provided your consent at the time of account registration, purchase, or enquiry submission; or
  • You have an existing relationship with us through a prior purchase or service engagement, and the communication relates to similar services

All marketing communications will comply with the Spam Act 2003 (Cth) and will include a clear and easy mechanism for you to unsubscribe at any time.

To opt out of marketing communications, you can:

Opting out of marketing communications will not affect your ability to receive service-related communications such as report delivery, account notifications, or responses to your enquiries.

Compliance Gaps and Legal Review Notice

The following compliance gaps and areas requiring solicitor review have been identified:

  • 1. APP 3 — Collection of Sensitive Information: If vehicle modification data could indirectly identify health conditions (e.g. disability vehicle modifications), this may constitute sensitive information under the Privacy Act. Legal review is recommended to confirm whether the sensitivity classification applies.
  • 2. APP 8 — Overseas Disclosure (Section 8): This policy discloses that data may be held overseas but does not name specific overseas recipients. Under APP 8, before disclosing to overseas recipients, reasonable steps must be taken to ensure those recipients do not breach the APPs. A solicitor should review whether a more specific disclosure or a cross-border data transfer agreement is required.
  • 3. Automated Decision-Making (Section 5): If the Risk Scan tool produces outputs that could materially influence financial, vehicle purchase or safety decisions, consider whether a more detailed automated decision-making policy is required. Australia does not yet have mandatory AI transparency laws equivalent to the EU AI Act, but this area is under active legislative review.
  • 4. Cookie Consent Mechanism: A privacy banner and preference management tool is now implemented on the website. Analytics is off by default and requires explicit opt-in. Visitors can change or withdraw their preference at any time via the footer “Privacy settings” control. Legal review is recommended to confirm whether this approach is sufficient for any EU or UK jurisdictions the website may serve.
  • 5. Data Breach Response Plan: The Privacy Act 1988 (Cth) — Notifiable Data Breaches (NDB) scheme requires eligible data breaches to be notified to the OAIC and affected individuals. A data breach response plan should be documented internally. This policy does not describe the NDB scheme obligations — consider adding a brief statement or ensuring internal procedures are in place.
  • 6. Children's Privacy: If minors under 18 may use the platform, additional protections are required. Consider adding a minimum age statement (e.g. "This service is intended for users aged 18 and over") and confirming parental consent procedures if applicable.
  • 8. Spam Act Compliance (Section 12): The marketing communications section references compliance with the Spam Act 2003. Ensure that email marketing systems include functional unsubscribe mechanisms and that consent records are maintained for each subscriber.

Recommended Additional Protections

  • A consent banner is now implemented; legal review should confirm it meets any EU/UK requirements if the site serves international users
  • Document an internal Notifiable Data Breach response plan and assign a privacy contact person
  • Add a minimum age restriction statement and confirm no collection of children's data
  • Review all third-party service provider agreements to confirm data processing obligations
  • Consider a data retention schedule document for internal use, aligned with tax and legal obligations
  • Once the Privacy Policy is published, add a link to it in all email footers and at the point of data collection (forms, checkout, Risk Scan)

This notice is for the attention of the business operator only and should be removed or moved to an internal document before the Privacy Policy is published for public use.
