The separate free preparation guides and Navigator cover ACT and NSW only. Confirm requirements with the registration authority or an appropriately authorised certifier.
ClearPath provides independent information and advisory services in the following areas:
ClearPath does NOT provide any of the following:
ClearPath is not a licensed engineer, legal practitioner, or accredited compliance certifier. Our services are informational and advisory in nature only.
By using our services, you acknowledge and agree that you are solely responsible for:
You acknowledge that an advisory report from ClearPath does not substitute for independent verification, engineering certification, or professional legal or mechanical advice.
All advisory assessments provided by ClearPath are based on one or more of the following:
All customer-supplied data is used as provided. ClearPath does not independently verify customer-supplied information against manufacturer records, NEVDIS, or any other verified database. Where vehicle specifications cannot be independently verified, any assessment or report will indicate this limitation.
ClearPath makes reasonable efforts to ensure the accuracy of information used in assessments, but does not warrant that any information is accurate, complete, current or suitable for any particular purpose. Information used in assessments may change over time due to regulatory updates, manufacturer revisions, or new standards. Assessments reflect the information available at the time of assessment only.
You expressly acknowledge and agree that:
Risk identification in a report does not mean that identified risks will necessarily eventuate, nor does the absence of a risk identification mean a risk does not exist.
6.1 General Limitation. To the maximum extent permitted by applicable Australian law, ClearPath, its operators, employees, contractors, and agents expressly exclude all liability for any loss or damage arising from your use of, or reliance on, any service, report, assessment, tool, or content provided by ClearPath — whether direct, indirect, consequential, incidental, special, or any other loss or damage of any kind.
6.2 Advisory Reliance. ClearPath is not liable for any decision made solely in reliance on an advisory report, risk scan, assessment, or any other information provided by ClearPath. You acknowledge that any such decision is your own, and that you have been advised to seek independent verification and professional advice.
6.3 No Liability for Third-Party Actions. ClearPath is not liable for decisions, actions, penalties, fines, enforcement actions, or outcomes arising from the conduct of any regulator, engineer, insurer, police authority, or other third party in connection with your vehicle, modifications, or towing setup.
6.4 Customer-Supplied Information. ClearPath accepts no liability arising from inaccurate, incomplete, or misleading information provided by you. Any assessment based on inaccurate customer-supplied information is made without fault on the part of ClearPath.
6.5 Australian Consumer Law. Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Remedies depend on the nature and seriousness of the service problem. Our Refund Policy explains how to request assistance and describes applicable remedies; its process does not postpone or limit your statutory rights. Any limitation of liability in these terms is subject to those rights.
6.6 Maximum Liability Cap. To the extent permitted by law and subject to clause 6.5, ClearPath's total aggregate liability to you for any claim arising under or in connection with these Terms and Conditions or your use of our services is limited to the amount paid by you for the specific service giving rise to the claim.
7.1 Pricing. All prices are displayed in Australian Dollars (AUD) and do not include GST. ClearPath is not currently registered for GST; no GST is charged. Pricing is subject to change without notice. The price applicable to your order is the price displayed at the time you complete your purchase.
7.2 Payment. Payment is required in full at the time of purchase. We accept payment via major credit and debit cards through our secure payment processor (Stripe). By making a payment, you agree to Stripe's terms of service.
7.3 Delivery. Services are supplied electronically using the method described for the purchased product. The $29 Detailed Weight Distribution Calculator & Report provides on-screen calculations and a printable summary that you can save using your browser; it does not include an automated advisory report. The standard $49, $99 and $149 assessments provide the automated report and PDF described before purchase, after verified payment and completion of the required intake. Expected delivery times and access-recovery steps are in the Service Delivery Policy. Any earlier, expressly agreed human-reviewed order follows its original confirmation.
7.4 Refund Policy. Refunds, service-problem remedies and duplicate-payment requests are handled under our Refund Policy. Receiving, accessing or downloading a report does not remove your rights if the purchased service is faulty, incomplete or not as described. A change-of-mind request is different from a remedy for a service failure. Contact support@clearpathmodificationadvisory.com.au with your order reference and a description of the problem; do not purchase again to report an access or delivery fault.
Nothing in this refund policy limits or excludes any right or remedy you may have under the Australian Consumer Law.
7.5 Cancellation. If you wish to cancel before the service is completed, contact us promptly so we can check whether processing has started and explain the available options under the Refund Policy. Automated generation may start immediately and cannot always be stopped. We do not ordinarily offer change-of-mind refunds after a service has been supplied as described. This does not limit cancellation, refund or other remedies for a service failure, or your statutory rights. Subscription renewal cancellations are covered separately in the Subscription Terms.

ClearPath's free tools, including the Towball Leverage Calculator and Caravan Weight Calculator, are provided for informational purposes only. Results from these tools are advisory estimates only and are subject to the same limitations set out in Sections 4, 5 and 6 of these Terms and Conditions.
These Terms and Conditions are governed by and construed in accordance with the laws of the Australian Capital Territory, Australia. Any dispute arising under or in connection with these Terms and Conditions is subject to the exclusive jurisdiction of the courts of the Australian Capital Territory and the Federal Court of Australia.
Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law or any other applicable national consumer protection legislation.
Personal, Business and Business Plus subscriptions are also governed by the Subscription Terms, including automatic renewal, cancellation, billing, plan limits and refunds.
The plan, price and billing interval shown at checkout form part of your agreement. Nothing in the Subscription Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.
ClearPath may update these Terms to reflect service, legal or operational changes. Updated Terms will be published with a revised "Last Updated" date. If a change materially affects an active paid subscription, we will give reasonable advance notice and explain the customer’s option to cancel before the change takes effect.
